Terms of service
This is the agreement for a Clear Deal concierge search. You accept it by paying the fee — there is nothing to sign and nothing to print.
1. Who you are dealing with
This agreement is between you and Clear Deal EV(“Clear Deal,” “we,” “us”), a licensed and bonded California motor vehicle dealer.

2. What this agreement covers — and what it does not
It covers one service: the concierge search — finding, screening and verifying a used Tesla against your brief, and advising you on it.
It does not cover:
- The purchase of any vehicle. The purchase contract is between you and the seller (section 7).
- A physical inspection of any vehicle. Inspections are a separate, separately priced service (section 6).
- Anything we have not agreed to in writing.
We provide search and selection only. Nothing in this agreement makes us your motor vehicle broker, purchasing agent or fiduciary, and nothing in it authorises us to sign, pay or commit to anything on your behalf.
3. The service and the fee
The fee is $899, flat, agreed and paid before we start. For it, we will:
- search the market across every channel we can reach — franchise and independent dealers, Tesla’s own used inventory, Carvana and CarMax, auction listings and private sellers;
- send you a first shortlist of real cars within 72 hours of the intake call;
- send you a written update every week the search runs — including the weeks when the honest update is “nothing good enough yet, and here is why”;
- verify your finalist against title and history records (section 6); and
- prepare your negotiation with the seller and support you through it.
One engagement covers one vehicle purchase against one brief, with one material revision to that brief included. Further rewrites are a new engagement at the then-current fee.
The fee pays for the search work, not for a car. It is earned by performing that work, and it is the same whether you buy or we advise you in writing to walk away.
4. The 60-day search window
The search runs for 60 days from the intake call. You may pause it once, for any reason, by telling us in writing, and restart it when you are ready; paused time does not count against the window. If we cannot reach you for 14 consecutive days, we may pause the search and will tell you we have done so.
Whatever pauses happen, the engagement ends no later than 6 months after the intake call.
5. Payment
The fee is flat and payable once, in advance. We never charge a percentage of the purchase price, and there is no balance at closing.
We do not receive a fee from the selling dealer.
If any compensation from a third party ever arises in connection with your engagement, we will disclose the amount to you in writing before you commit to anything.
6. Vehicle history checks
We run a title and history pre-screen on every car we take seriously, and pull the full Carfax on finalists. One engagement includes up to 30 NMVTIS title pre-screens and up to 10 full Carfax reports. If your search needs more, we will tell you first and pass the extra reports through at cost, only with your agreement.
These are records checks, produced by third parties. We read them carefully, but we do not control them and cannot warrant that any report is a complete record of a vehicle’s history.
A physical inspection of any vehicle is not included in this service or its fee. We offer inspections as a separate, separately priced service, and we will quote the price before you order one.
7. The purchase
The search ends with a verified finalist and our written verdict. The decision to buy — and the purchase itself — is yours. The purchase contract is between you and the seller, and California requires it to be signed on paper: electronic signatures are not valid on motor vehicle sales contracts in this state.
Under this agreement we do not negotiate final terms for you, sign anything for you, hold your funds, or act as your motor vehicle broker, and we have no authority to bind you to any transaction.
8. If the window closes without a purchase
You receive a written closing report: what we screened, what we rejected, and why nothing cleared the bar. That report, and the search behind it, is the work the fee paid for; no refund is owed because the market did not produce a car.
You may restart the search within 90 days at 50% of the then-current fee. Your brief and everything we learned carry over.
9. What we need from you
You agree to give us accurate information for your brief, to stay reachable while the search runs, and to decide when a car appears — good cars sell in days. If we cannot reach you, section 4 applies.
10. What we do not promise
We do not promise that a car matching your brief will exist, or be available at any particular price, during the window. The market decides that. We promise the work in section 3, performed with care and reported honestly.
Our shortlists, reports and verdicts are professional advice to inform your decision. The decision, and the transaction, are yours.
11. Liability
To the maximum extent California law allows, our total liability under this agreement is limited to the fee you paid us, and neither party is liable to the other for indirect, incidental or consequential damages. Nothing in this section limits liability that cannot be limited by law.
12. Accepting these terms
Paying the fee — through our checkout, a payment link we send you, or any other method we agree — is your acceptance of this agreement. Under California law (Civil Code §1633.1 and following) and the federal E-SIGN Act, that electronic acceptance is binding without a signature.
13. Governing law and disputes
This agreement is governed by California law. Any dispute arising out of it will be resolved in the state or federal courts located in Los Angeles County, California. Before filing anything, call us — most problems are solved with a phone call.
14. Changes, and the whole agreement
We may update these terms. The version in force for your engagement is the one published when you paid; ask and we will send you a copy. Material changes will be posted here with a new effective date.
This page, your payment record and your written brief are the entire agreement for the search. If any part of it turns out to be unenforceable, the rest remains in force.
